The terms “we,” “us,” and “our” refer to Edge Case Labs. Edge Case Labs operates this store and website, including all related information, content, features, tools, products, and services provided to you (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you use the Services.

We do not guarantee that the appearance or quality of a product will exactly match how it appears in photographs, mockups, digital renderings, or other images displayed through the Services.

We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase the selected products.

Edge Case Labs reserves the right to accept, reject, modify, or cancel an order where reasonably necessary. An order is not considered accepted until your payment has been successfully processed and we have confirmed your order.

Please review your order carefully before submitting it. Once an order has been accepted or entered processing, we may be unable to accommodate cancellation or modification requests.

If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing information, or other contact information provided with your order.

Purchases are subject to our Refund Policy.

Unless otherwise agreed in writing, purchases are intended for personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

The price charged for a product will generally be the price displayed when the order is placed and will be reflected in your order confirmation.

All processing, shipping, and delivery dates are estimates unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, customs processing, severe weather, service interruptions, or other events outside our reasonable control.

Orders may be subject to additional processing time as disclosed on the applicable product page, including products offered on a preorder or made-to-order basis.

Risk of loss may transfer in accordance with applicable law and the terms of the shipping carrier.

SECTION 6 – INTELLECTUAL PROPERTY

The Services and their content, including but not limited to our artwork, original designs, product designs, graphics, illustrations, photographs, videos, audio, text, branding, logos, website design, and other creative materials, are owned by or licensed to Edge Case Labs and are protected by applicable intellectual property laws.

These Terms permit you to access and use the Services for personal, non-commercial purposes only.

Unless we give you prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, or transmit our protected materials.

Nothing in these Terms grants you ownership of or a license to any intellectual property belonging to Edge Case Labs, Shopify, or any third party except as expressly provided.

The Edge Case Labs name, branding, logos, product names, designs, and slogans may not be used without authorization.

Shopify's trademarks and intellectual property remain the property of Shopify. Other trademarks appearing through the Services belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools or features operated by third parties that we do not control or monitor.

Access to these tools is provided “as is” and “as available,” without warranties, representations, conditions, or endorsement by Edge Case Labs.

Your use of third-party tools is at your own risk and discretion. You are responsible for reviewing and agreeing to the applicable third party's terms before using those services.

Edge Case Labs is powered by Shopify, which provides technology that enables us to offer the Services.

However, purchases from our store are transactions directly between you and Edge Case Labs.

By using the Services, you acknowledge that Shopify is not the seller of products purchased from Edge Case Labs and is not responsible for the transaction between you and Edge Case Labs, including injuries, damages, or losses resulting from products purchased from us.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to transactions with Edge Case Labs.

SECTION 10 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify may also collect and process personal information relating to your access to and use of the Services.

  • You have disclosed any compensation or incentives associated with the Feedback where required; and

  • Your Feedback does not violate these Terms or the rights of another person.

Unless otherwise required by law, we are not obligated to keep Feedback confidential, provide compensation for Feedback, or respond to Feedback.

We may monitor, edit, decline to publish, or remove Feedback that we determine violates these Terms or applicable law.

You may not submit Feedback that infringes another person's copyright, trademark, privacy, publicity, or other legal rights or that contains unlawful, abusive, obscene, defamatory, or malicious content or software.

You are responsible for the accuracy and legality of Feedback you submit.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

SECTION 17 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EDGE CASE LABS AND ITS AFFILIATES, PARTNERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS APPLICABLE AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS.

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Edge Case Labs, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal expenses arising from:

  2. Your violation of applicable law or the rights of another person; or

  3. Your misuse of the Services.

We will provide reasonable notice of an indemnifiable claim where practicable. You agree to reasonably cooperate in the defense of such claims.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and the unenforceable portion will be considered severed from these Terms.

The remaining provisions will remain valid and enforceable.

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and rules referenced or posted through the Services, constitute the entire agreement between you and Edge Case Labs regarding your use of the Services and supersede prior agreements or communications regarding the same subject matter.

We may assign or transfer our rights and obligations under these Terms as permitted by applicable law.

These Terms and any separate agreements through which Edge Case Labs provides Services will be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise.

Any dispute subject to court jurisdiction will be handled in an appropriate court with jurisdiction under applicable law.
